Terms & Conditions
These Terms & Conditions ("Terms") govern your purchase and use of Optimz, sold by Manuel Berrang, 66386 St. Ingbert, Germany ("we", "us"). By purchasing or using Optimz, you agree to these Terms.
1. The Product
Optimz is a Windows desktop customization application, including an animated taskbar overlay, custom cursor effects, video wallpapers, and a floating music widget. Optimz requires a valid license key to activate, purchased through our payment provider, Lemon Squeezy.
2. Ordering and Payment
All purchases are processed by Lemon Squeezy Inc., acting as Merchant of Record. Lemon Squeezy handles payment collection, invoicing, and applicable sales tax/VAT on our behalf. By purchasing, you also agree to Lemon Squeezy's own terms of use, available at lemonsqueezy.com.
Prices are shown in the currency and amount displayed at checkout and may change at any time for future purchases (existing licenses are unaffected).
3. License
Upon successful payment, you receive a license key granting you a personal, non-transferable license to use Optimz on up to two (2) devices, as further described in our End User License Agreement (EULA), available at [LINK ZU DEINER EULA-SEITE].
4. Delivery
Your license key is delivered automatically via email immediately after purchase. The installer can be downloaded from the link provided in your order confirmation or from the Microsoft Store, where available. If you do not receive your key within a reasonable time, please check your spam folder before contacting us.
5. Right of Withdrawal (EU Consumers)
Under EU consumer law, you generally have a 14-day right of withdrawal for online purchases. However, since Optimz is digital content delivered immediately upon purchase (your license key), this right may be waived once you confirm activation/download, in accordance with Art. 16(m) of EU Directive 2011/83/EU.
We additionally offer a voluntary 14-day money-back guarantee from the date of purchase, provided the license has not been abused (e.g. excessive activations, chargebacks).
Refund requests are subject to Lemon Squeezy's refund policy and should be submitted through your Lemon Squeezy order/customer portal, or by contacting us directly.
6. Your Obligations
You agree not to:
Share, resell, or redistribute your license key
Attempt to circumvent the license activation system
Use the Software for any unlawful purpose
Misrepresent your identity when purchasing or activating a license
7. Availability and Updates
We aim to keep Optimz available and up to date but do not guarantee uninterrupted availability. We may release updates that add, change, or remove features at our discretion.
8. Liability
To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, or consequential damages arising from your use of Optimz. Nothing in these Terms limits liability for damages caused intentionally or through gross negligence, or for injury to life, body, or health, as required under German law (§ 309 Nr. 7 BGB).
9. Third-Party Components
Optimz includes third-party components (including TranslucentTB), each subject to their own respective open-source licenses.
10. Community Guidelines (Discord)
Access to our Discord community is optional and subject to Discord's own Terms of Service, as well as our server's community rules (available in the server itself upon joining).
11. Changes to These Terms
We may update these Terms from time to time. Continued use of Optimz after changes take effect constitutes acceptance of the revised Terms.
12. Governing Law and Jurisdiction
These Terms are governed by the laws of Germany. If you are a consumer, this does not deprive you of any mandatory consumer protections under the law of your country of residence.
